Fair wear and tear or damage? The line that decides your deposit

In Luxembourg, a landlord can only withhold the deposit for genuine damage or unpaid rent. Fair wear and tear is never the tenant's responsibility. That is the whole difference between a home that has simply been lived in and one that has been damaged or left dirty.

Deposit: 2 months maximum, refunded in two stages

Since the rental-law reform that came into force on 1 August 2024, the rental deposit is capped at 2 months' rent (excluding charges). The first half must be refunded within one month of handing back the keys, provided the exit inventory matches the entry one and the rent is paid; the balance within one month of the final service-charge statement. If the refund is unjustifiably delayed, the law provides for compensation of 10% of the monthly rent per month of delay in the tenant's favour.
